1. Acceptance of Terms
By accessing and using BandSync Library ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
BandSync Library is a music library management platform designed for bands, orchestras, and musical ensembles to organize, track, and manage their sheet music collections. The Service provides:
- Digital cataloging of musical pieces
- PDF upload and viewing capabilities
- Inventory tracking for parts and instruments
- Collaboration tools for ensemble management
- Analytics and reporting features
3. User Accounts
3.1 Registration
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Organization Accounts
Organizations are created by administrators who are responsible for managing users, content, and subscription status within their organization.
3.3 Account Security
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
4. Subscription and Payment
4.1 Free Trial
New organizations receive a 30-day free trial with access to up to 10 musical pieces. No payment information is required for the trial period.
4.2 Paid Subscriptions
After the trial period, continued use requires a paid subscription:
- Monthly Plan: £9.99 per month
- Annual Plan: £99.99 per year (save 17%)
Paid subscriptions include up to 5 users and 5,000 musical pieces.
4.3 Billing
Subscriptions automatically renew until cancelled. Payments are processed securely through Stripe. You will be billed in advance for each billing period.
4.4 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, your account will enter read-only mode at the end of the current billing period. All data will be preserved but editing and uploading will be disabled.
4.5 Refunds
Refunds are not provided for partial billing periods. If you cancel mid-cycle, you retain access until the end of the paid period.
5. Copyright and Intellectual Property
5.1 Your Content
You retain all rights to the musical works and materials you upload to the Service. By uploading content, you represent and warrant that:
- You own or have legal rights to all uploaded materials
- Your content does not infringe on any third-party copyrights or intellectual property rights
- You have obtained all necessary licenses and permissions for materials under copyright protection
5.2 Our Service
The BandSync Library software, design, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.
5.3 License to Use
You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you and your organization.
6. Acceptable Use
You agree not to:
- Upload or share content that infringes copyrights or intellectual property rights
- Use the Service for any illegal purposes
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Share your account credentials with unauthorized users
- Use automated tools to scrape or download content
- Resell or redistribute the Service without authorization
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your data and complying with applicable data protection laws including GDPR.
8. Data Retention and Deletion
8.1 Active Accounts
Your data is stored and backed up regularly while your account is active or in read-only mode.
8.2 Account Deletion
You may request deletion of your organization account at any time. Upon deletion:
- All uploaded content will be permanently deleted
- User accounts associated with the organization will be removed
- This action is irreversible
8.3 Trial Expiration
If your trial expires without upgrading, your account enters read-only mode. Data is retained for 30 days to allow for potential subscription, after which you may be asked to upgrade or data may be subject to deletion.
9. Service Availability
9.1 Uptime
We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, updates, or due to factors beyond our control.
9.2 Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for copyright infringement by users
- We are not liable for loss of data due to user error or account deletion
11. Indemnification
You agree to indemnify and hold harmless BandSync Library, its owners, and operators from any claims, damages, or expenses arising from:
- Your use of the Service
- Your uploaded content
- Your violation of these Terms
- Your infringement of any third-party rights
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
13. Termination
We may terminate or suspend your account if you violate these Terms, engage in fraudulent activity, or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
